Terms and conditions

1. Purpose and scope

These terms and conditions (the "Terms") govern the relationship between Honowa Technologies, operating the ZoomLab brand (the "Provider"), and any individual or organisation (the "Customer") who orders one of the following services:

• registration, renewal and transfer of domain names, including .cm;
• shared web hosting and related services (email, SSL certificates, backups).

Placing an order implies full acceptance of these Terms. They are drawn up in accordance with Law No. 2010/021 of 21 December 2010 governing electronic commerce in Cameroon.

2. Orders

2.1. The Customer orders through the Website form, by email or on WhatsApp, specifying the service and, for a domain name, the exact identity of the registrant.

2.2. The Provider confirms availability, the amount and payment terms. The order becomes binding upon receipt of full payment and, for domain names, the required documents.

2.3. The Customer guarantees that the information provided is accurate. False or incomplete information may lead to suspension or deletion of the service, in line with registry rules.

3. Prices and payment

3.1. Prices are shown on the Website in CFA francs (XAF). They are payable in advance, for twelve (12) months unless stated otherwise.

3.2. The registration and renewal price of a .cm domain name is set by ANTIC. Any change to this price by the authority applies to the Customer at the next renewal.

3.3. Accepted payment methods: MTN Mobile Money, Orange Money, bank transfer, cash at the Provider's office. An invoice is issued for every payment.

3.4. The price of a hosting plan is the same at purchase and at renewal, unless a price change is notified to the Customer at least thirty (30) days before the due date.

4. Activation

4.1. Hosting is normally activated within twenty-four (24) working hours of receipt of payment.

4.2. The domain name is submitted to the registry as soon as payment and documents are received. Activation time depends on the registry and is usually 24 to 72 working hours. Until registration is confirmed by the registry, availability of a name is not guaranteed: if the name is unavailable, the Customer is refunded in full or may choose another name.

5. Domain names

5.1. The domain name is registered in the Customer's name (or the registrant they designate), who is its sole holder. The Provider acts as registrar.

5.2. The Customer agrees to comply with the .cm registration policy and ANTIC's rules, and guarantees that the chosen name does not infringe third-party rights (trademarks, trade names, surnames, etc.).

5.3. The domain name included in a hosting plan is renewed with it for as long as the plan is active and paid. If hosting is not renewed, the domain name can be renewed separately at the current price.

5.4. The Customer may request the transfer of their domain name to another registrar at any time; the Provider supplies the necessary code and assistance within a reasonable time.

6. Hosting

6.1. The Provider makes hosting space available to the Customer in line with the chosen plan's specifications (storage, email accounts, SSL certificate, etc.).

6.2. "Unlimited traffic" means the Provider does not charge for the volume of data transferred. Usage must nonetheless remain normal for shared hosting: a website consuming excessive shared resources (CPU, memory, simultaneous connections) may be limited after the Customer has been informed, and a suitable plan will be offered.

6.3. The Provider performs regular backups as a safety measure. The Customer remains responsible for keeping their own backup copies.

6.4. The Provider targets 99.9% service availability, excluding scheduled maintenance announced in advance and force majeure events.

7. Prohibited use

The Customer shall not use the services for: unsolicited email (spam), hosting unlawful content (in particular under Law No. 2010/012 of 21 December 2010 on cybersecurity and cybercrime in Cameroon), counterfeiting, phishing, distributing malware, cyberattacks, or any activity that breaches public order or third-party rights.

Any breach may lead to immediate suspension of the service without refund, without prejudice to any legal action.

8. Liability

8.1. The Provider has a best-efforts obligation. It cannot be held liable for content published by the Customer, for interruptions caused by the Internet, power or telecommunications providers, or for indirect damage (loss of revenue, data or customers).

8.2. In any event, the Provider's liability is limited to the amount paid by the Customer for the service concerned over the previous twelve (12) months.

8.3. The Customer is solely responsible for the content they host, the security of their login details and keeping their applications up to date (WordPress, plugins, etc.).

9. Term, renewal and termination

9.1. Services are ordered for the period paid. The Provider reminds the Customer of the due date by email and/or WhatsApp at least thirty (30) days in advance.

9.2. If not renewed, hosting is suspended on the due date and then deleted, with all data, thirty (30) days later. The domain name follows the grace and recovery periods set by the registry.

9.3. Cancellation and refunds: hosting may be cancelled within thirty (30) days of first activation, with a pro-rata refund of the unused period. Domain name registration fees are non-refundable once the registration has been made with the registry.

10. Personal data

The Provider processes the Customer's personal data in accordance with Law No. 2024/017 of 23 December 2024 on the protection of personal data in Cameroon and its privacy policy. The domain registrant's data is passed on to the registry (ANTIC) as required by regulations.

11. Force majeure

Neither party can be held liable for a failure resulting from force majeure, including general power or Internet outages, natural disasters or decisions by a public authority.

12. Changes to the Terms

The Provider may amend these Terms. The applicable terms are those in force on the date of the order or renewal.

13. Governing law and disputes

These Terms are governed by Cameroonian law. In the event of a dispute, the parties will seek an amicable solution before taking any action. Failing that, the competent courts of Douala shall have sole jurisdiction.
